Terms of service
Effective date: September 15, 2026
These terms govern your use of Optan Age Verification (the “App”), published by Optan (“we”, “us”), as a merchant on the Shopify platform. Installing or using the App means you accept these terms.
The service
Section titled “The service”The App lets Shopify merchants display an age-verification gate on their online storefront: a full-screen prompt asking visitors to confirm their age by declaration (Yes/No) or by entering a date of birth, with configuration options described in the documentation. The App is provided through the Shopify App Store and runs inside your Shopify admin and Online Store theme.
Plans, billing and trial
Section titled “Plans, billing and trial”The App offers a Free plan and a Pro plan (currently $4.99 / month with a 7-day free trial). All charges are billed by Shopify through your Shopify account, under Shopify’s billing terms. You can cancel at any time from the App or your Shopify admin; cancellation takes effect per Shopify’s subscription mechanics, and Pro features then revert to Free-plan behavior as described in Plans. Prices may change with reasonable notice; changes never apply retroactively.
Your responsibilities
Section titled “Your responsibilities”- Legal compliance is yours. The App is a tool that helps you implement an age-affirmation step. You are responsible for determining which laws apply to your products and markets (minimum ages, whether a declarative gate is sufficient, cookie disclosures, and anything else), and for configuring the App accordingly.
- Correct configuration. The gate only protects your storefront when it is enabled, the theme embed is active on your published theme, and the scope matches your restricted catalog. The App provides setup checks and an attestation, but verifying that the gate is live on your store remains your responsibility.
- Lawful use. You will not use the App to mislead visitors or regulators, or in violation of Shopify’s terms.
What the App is not
Section titled “What the App is not”- Not identity verification. The gate records a visitor’s declaration. It does not check identity documents and cannot guarantee a visitor’s real age. Jurisdictions that require documentary age verification need a dedicated identity-verification provider in addition to, or instead of, a storefront gate.
- Not legal advice. Nothing in the App, its attestation, or this documentation constitutes legal advice. Consult a qualified professional for your specific obligations.
- Not tamper-proof. Like any client-side storefront mechanism, the gate can be circumvented by a visitor who disables JavaScript or manipulates their browser. This is inherent to all storefront age gates.
Availability and support
Section titled “Availability and support”We aim to keep the App available and functional at all times, but the service is provided “as is” and “as available”, without warranty of uninterrupted operation. The App depends on the Shopify platform; outages or changes on Shopify’s side may affect it. Support is provided by email at support@optanapps.com — see Support.
Our processing of data is described in the privacy policy, which forms part of these terms. In short: no personal data about your shoppers, EU hosting, deletion after uninstall.
Limitation of liability
Section titled “Limitation of liability”To the maximum extent permitted by law, our total liability arising out of or related to the App is limited to the amounts you paid us for the App in the twelve months preceding the claim. We are not liable for indirect or consequential damages, lost profits, or regulatory penalties incurred by your store — including penalties related to underage access, which depend on your configuration and your jurisdiction’s requirements. Nothing in these terms excludes liability that cannot lawfully be excluded.
Termination
Section titled “Termination”You can stop using the App at any time by uninstalling it, which removes the gate from your storefront and triggers the data deletion described in the privacy policy. We may suspend or terminate the App for abuse, non-payment (via Shopify), or if the App is withdrawn from the App Store, with reasonable notice where practicable.
Intellectual property
Section titled “Intellectual property”The App, its code, design and documentation are our property. These terms grant you a non-exclusive, non-transferable right to use the App on your Shopify store while it is installed. Your store’s content and data remain yours.
Changes to these terms
Section titled “Changes to these terms”We may revise these terms; the effective date above reflects the latest version. Material changes will be announced through the App or by email. Continued use after changes take effect constitutes acceptance.
Governing law
Section titled “Governing law”These terms are governed by French law. Disputes that cannot be resolved amicably fall under the jurisdiction of the competent French courts, without prejudice to mandatory consumer or local protections that may apply to you.
